What law regulates car parks?
The legislation that regulates the parking of vehicles in a parking lot is Law 40/2002, of November 14, regulating the vehicle parking contract. This regulation establishes the legal regime applicable to car parks in which a person transfers, as a commercial activity, a space he owns for the parking of motor vehicles. In exchange for a price determined by the time of parking, the owner of the parking must comply with some duties of surveillance and custody during the time of occupation. Also, this legislation defines what are the parkings recognized as parking.

What are the obligations of a parking?
This law establishes the responsibility of the holders of a parking lot with their customers, who must:

  • Facilitate a space for parking the vehicle.
  • Give you a receipt or proof of parking, where the day and time of entry is indicated if this is a determining factor for setting the price.
  • Return, as long as you deliver the receipt, the vehicle and the components and accessories that are functionally incorporated (that is, fixedly and inseparably) in the car in the state in which you delivered it. For its part, the restitution of non-fixed and removable accessories, such as radios, GPS or mobile phones, is not the responsibility of the owner of the parking.
  • On the other hand, if your parking is responsible for other objects, such as non-fixed and removable accessories, you should check that there are preventions and security measures that you have been indicated. With this special service the owner of the parking can set different or complementary prices.
  • Indicate easily visible prices, schedules and rules of use and operation of the parking, which can be established freely.
  • Have claim forms.

    What are the responsibilities of a parking?

  • The owner of the car park must respond, both to the customer and to the owner of the vehicle, for the damages that may be caused by the total or partial breach of the obligations set forth in the Law.
  • If you make a claim for compensation for damages to your parking, you can request the mediation and arbitration of the Consumer Arbitration Boards.
  • he owner of the car park has the right of retention on the vehicle to guarantee the payment of the parking price.

    But you, as a client, also have some duties to fulfill so that the service offered by the parking is as complete and satisfactory as possible. What you should do when you go to a parking lot is the following:

  • Pay the fixed price before removing the vehicle.
  • Show or deliver proof or receipt of parking.
  • In case you lose the receipt, you must prove your right to the vehicle to proceed to remove it.
  • Follow the rules and instructions of the parking in relation to the use and security.
  • If your parking is responsible for other objects, such as non-fixed and removable accessories or car keys, you must record all these items.
